Terms of service

What this service is

Cloutboard is a public leaderboard where creators bid to place their profile at the top. A profile brings your public accounts together in one place, and the higher your position, the more prominently it is shown. A position is the total that has been contributed to it — the highest total holds the top spot until somebody contributes more, and position is determined solely by the amount paid.

A contribution buys a chance to appear on the board at the position that amount can support at the moment it is confirmed. It does not buy traffic, clicks, followers, a fixed duration at a rank, search-engine ranking, or any particular result. Someone else can contribute more and move ahead, and the Today, week and month boards only count activity within their window. We may change, pause, or discontinue features, including the boards, categories, and how positions are priced.

A position is a paid placement. It is not an award, an endorsement, a review, or a measure of quality, popularity or performance. Nothing here ranks creators by audience size, engagement, or merit of any kind, and no such claim may be made about a position held here.

Who we are, and getting in touch

Cloutboard is operated by Gopal, an individual based in India. Our primary contact is @gopalsays108 on X; legal and listing notices may also be sent to gopalsays108@gmail.com.

These Terms work together with the public Rules. If the Rules and these Terms conflict, these Terms control.

Contributing

• Every contribution is priced by our servers at the moment of payment, from live data. A price shown in your browser is an estimate that can change before you pay.
• To join the board a contribution must clear the board’s floor, and to lift a position it must beat the total ahead of it by the published increment, up to the board’s ceiling.
• A contribution takes effect only after we have verified the payment with the payment provider. A success message in your browser is not, by itself, a confirmed position.
• You may be overtaken at any time, including immediately. See Refunds.

Who can use it

• You must be at least 18 years old and able to form a binding contract.
• If you use the service for a company, you represent that you have authority to bind it, and “you” includes that company.
• You may not use the service if you are barred from receiving it under applicable law, including trade sanctions.

Payments, Dodo Payments, and taxes

Checkout is processed by Dodo Payments. We do not collect or store full payment-card numbers — those are handled by Dodo Payments, whose own terms and privacy notice also apply to the payment itself. Amounts are priced in US dollars, and applicable taxes may be added at checkout.

Minimums, increments, and the raise-only-the-difference charge are described in the Rules and shown before you pay. Completing checkout is an offer to buy placement on those terms. A position is assigned when payment is confirmed and the contribution is written to the board, at whatever position that amount then supports.

Refunds

A contribution is a placement delivered the moment payment is confirmed and consumed continuously, so it is not refundable on request. Being overtaken later, a drop on a timed board once its window moves, fewer clicks than you hoped for, a category you dislike, or a removal for breach of these Terms does not create a refund. By completing checkout you ask us to start this digital service immediately and, to the extent the law allows that waiver, give up any statutory cooling-off right; where a mandatory consumer right cannot be waived, we honour it.

We do refund when we cannot honour a contribution: a payment captured but never applied — because the profile was removed or the board closed — is returned in full, and duplicate charges are refunded. The full policy is on the Refunds page. A chargeback or reversed payment without a legally required basis is a breach of these Terms; we may remove the affected position and refuse future use of the service.

Profiles and who may support them

Profiles may be submitted by anyone, and a contribution may be made for a profile you do not own — anyone can support a creator. Submitting a profile does not transfer any rights in it, and a public profile appearing here implies no relationship with, or endorsement by, its owner.

If a profile belongs to you and you want it removed, contact us and it will be taken down. Any position it holds ends at removal, and contributions already spent on it are not refunded — see Refunds.

What you promise us

By submitting a profile, a link, or a payment, you confirm that:

• You have the right to list that destination and to send visitors there.
• The listing and its destination comply with all applicable laws.
• You are not impersonating another person, brand or company, and you are not falsely claiming to represent a creator you have no authority over.
• The destination is not malware, phishing, a scam, or a page whose main purpose is to deceive visitors.
• The information you submit is accurate, and you will keep it so.

What is not allowed

• Sexual, pornographic or adult-platform content; chat, invite or messaging-group links; or link shorteners used to hide the real destination.
• Content that is illegal, fraudulent, defamatory, harassing, hateful, violent, or that exploits children.
• Counterfeit goods, unauthorised streaming, or other infringement of copyright, trademark or other rights.
• Automated contributions, scraping beyond ordinary browsing, manipulating click or visitor counts, bypassing rate limits, or any attempt to interfere with how positions are calculated.

We may remove a profile, cancel a contribution, or block an account for any of these. Where money was taken for a position we then remove for a reason that is our fault, it is refunded.

Our right to remove listings

We may refuse, delay, edit, recategorise, hide, or permanently remove any profile, position, or related page, with or without notice — including where we believe these Terms, the Rules, or the law may have been broken; where a rights holder or a platform complains; or where a listing creates legal, security, or reputational risk. Removal for breach does not entitle you to a refund.

Names, images, and fair use

To run the board we fetch and display publicly available information about listed accounts: names, @handles, titles, descriptions, avatars, and thumbnails. We use that material only to identify the listed creator on Cloutboard and to show visitors where a position leads. We do not use it as our own brand, and we do not suggest sponsorship or endorsement by the account owner unless the owner is the one who listed it.

Cloutboard, our wordmark, and the look of the service are ours. You may not copy the service or scrape the board for a competing product. X, Dodo Payments, and other third-party names remain their owners’ property.

Complaints and rights notices

If you believe a listing infringes your copyright, trademark, publicity or other rights, or that a listed destination is unlawful, contact us at @gopalsays108 or gopalsays108@gmail.com with: your name and contact details; the profile on Cloutboard; the destination link or @handle; a description of the problem; and a statement that the notice is accurate and that you are the rights holder or authorised to act. We may remove or restrict the listing while we review, and may share the notice with whoever listed it.

No endorsement, no earnings claims

Appearance on the board is not our opinion of a creator. We do not verify that listed accounts, claims, or results are true. Visitor and click counts describe what our systems recorded; they are not a promise that you will get the same outcome. Your results depend on your position, your accounts, timing, and factors we do not control.

Links from the service to listed accounts leave Cloutboard, and those destinations have their own terms and practices that we are not responsible for.

Availability and changes

The service is provided as it is, without a guarantee of uninterrupted availability. Boards, pricing rules, categories and the number of visible positions may change, and we may change these Terms. If a change is material we will update the date at the top of this page, and continued use after that means you accept the new Terms. For a payment already completed, the Terms in effect at checkout still apply to that payment, except where a change is required by law or to address a security or legal risk.

Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or free of errors, or that listings, names, images, positions, or counts are accurate or complete.

Limitation of liability

To the extent the law allows, we are not liable for lost profits, lost data, lost goodwill, or other indirect, incidental, special or consequential damages. Our total liability for any claim relating to a payment is limited to the amount you paid us for the position that the claim concerns in the three months before the claim. Nothing here limits liability that applicable law says cannot be limited.

Indemnity

You will indemnify and hold harmless Gopal and the people working on the service from claims, damages, losses and reasonable legal fees arising out of your listing, your destination, your payment or chargeback, your breach of these Terms, or your infringement of someone else’s rights.

Governing law and grievances

These terms are governed by the laws of India, and any dispute is subject to the courts there. We operate as an intermediary hosting user-submitted profiles, and comply with India’s IT Rules and the Digital Personal Data Protection Act, 2023. Where you are a consumer with a mandatory local right that cannot be displaced, that right still protects you.

Complaints — about a listing, your data, or anything on the platform — go to @gopalsays108 on X or gopalsays108@gmail.com. We acknowledge within 48 hours and aim to resolve within 15 days.

General

• If a part of these Terms is unenforceable, the rest stays in effect, and the invalid part is replaced by the valid term closest to its intent.
• Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them if the service is transferred.
• These Terms, the Rules, the Privacy Policy, and the checkout details you confirm form the entire agreement for the service.
• Payments, hosting and analytics involve third parties, including Dodo Payments; their outages or decisions are outside our control.
